Rule 1-400 outlines guidelines on communications and advertising until November 2018. Rule 1-400 had 15 standards on what a form of communication but did not explicitly mention electronic or Internet advertisements. Rule 1-400 were still supposed to enforce rules similar to print and online advertisements even without explicit guidelines.
On November 1, 2018, per a California Supreme Court ruling, California Rules of Professional Conduct went into effect. These guidelines detail requirements and rules regarding both electronic and print medium advertisements.
California Rules of Professional Conduct do not discuss website marketing within its rules. The Formal Ethics Opinion 2001-155 holds that attorney’s websites must be the general requirements of print attorney advertisements, although websites are a form of communication, not a solicitation.
California attorneys and firms can utilize social media platforms, such as Instagram, Twitter, and Linkedin, among others. Social media can connect attorneys to a broader group of individuals in need of needing legal services.
