There are regulations that apply to donors and those that utilize sperm donors. Here’s what you need to know about sperm donation in California.

A known sperm donor may be preferred by some couples. It is not illegal in California and can even be an easier process because oftentimes, the six-month quarantine is waived.

Known Sperm Donation in California: The Basics

A Known Donor Account is the same as a Directed Donor but for this account, however, the recommended 6-month quarantine of the semen samples is waived. Approval to waive the 6-month quarantine is given after all screenings, health history documents, and physical exam results have been reviewed. A 6-month quarantine may be required if the information provided shows a higher risk of disease transmission and some fertility clinics will not accept vials that have not been quarantined. Party should verify with a medical provider that waiving the quarantine is an option and upon their visit prepare funds to open an account and make a deposit.

A Known Donor should collect each sample within 7 days of the Sexually Transmitted Infections blood and urine testing. It takes approximately 30 to 45 days for stored vials to be available for release after STI tests and documents are reviewed and approved for release. Vials stored in this type of account will be releasable approximately 30-45 days after the account is opened.

Reasons to Use Sperm Donation

Sperm donation is used for various situations, same-sex couples, or couples where the male sperm is not suitable. The use of donor sperm in intrauterine insemination and in vitro fertilization is the most common type of third-party reproduction.

Known Donor vs. Anonymous Donor

Two primary options dominate the sperm donation process: known donors and anonymous donors.

Known donor

Those whose age, sex, education, and many other characteristics are available. This can include but is not limited to the following:

  • Friend
  • Family member
  • Known acquaintances met in person or online

Anonymous donor

Predominantly done by way of sperm bank or with online services. Individuals who choose an anonymous donor do not know the identity of the donor and will not know in the future.

Sperm Donation Laws in California

Those using a sperm donor to create their family should know that the sperm donor has no guardian responsibility to the child. While it is more common for sperm donors to be anonymous, there are some instances where the donor can be contacted after the child reaches 18. However, the parents must decide what is the best situation for their family, as there are implications for both sides of the decision. At sperm banks, it is common for parents to look for donors who have similar characteristics such as medical and genetic history, academic achievements, or any other similarity.

Costs of the Procedure

The cost of donor sperm will vary based on personal needs. At a minimum, you will need to pay for vials and FedEx shipping.

Those planning on doing only one IVF cycle may only need 1-2 vials shipped which should total approximately $1,000 to $2,000. However, it usually takes about 3-4 IUI cycles to achieve pregnancy and the cost of vials and shipping for 4 cycles comes out to approximately $4,800. Those planning on doing IUI cycles who would like to have two children are recommended to purchase at least 8 vials, an approximate total of $9,000, because donors are often likely to sell out.

Many insurance companies view fertility as an “elective” procedure, and not a “disease” of the reproductive system so it is rarely covered by insurance plans. However, in the last couple of years, there has been a positive trend in the coverage of these services by some companies. Parties should double-check their insurance policy regarding coverage of these specific services to see what, if any, they can get covered. Most facilities may not have the technology to bill insurance companies directly for reimbursement, but can still provide an invoice to assist in completing the insurance claim form.

Understanding Which Vial is Required

Different procedures require different types of vials.

An IVF procedure allows parties to use any type of vial offered.

An intrauterine insemination procedure allows parties to use IUI Premium Vials which should be washed and IUI ready. ICI Premium Vials may also be used as long as the clinic has washed the specimen prior to insemination.
