The Smoke-Free Illinois Act

The Smoke-Free Illinois Act aims to limit the harmful consequences of second-hand smoking. Illinois recognizes that individuals may decide to risk their health by smoking. However, it is unethical for others to be at risk from another’s smoking habits.

The Smoke-Free Illinois Act creates laws to prohibit smoking within 15 feet of an entrance, exit, opening windows, or ventilation intake. Designated smoke-free zones are any areas under the control of a private or public employer where employees can enter, leave, or pass through while working.

The Smoke-Free Illinois Act also prohibits individuals from smoking in taxis, buses, shuttles, or any state-owned vehicle.

Failure to Comply with The Smoke-Free Illinois Act

If employers fail to comply with The Smoke-Free Illinois Act parameters, they may receive a $250 fine for a first offense, $500 fine for the second offense, and a minimum of a $2,500 fine for any violations within a year of the first offense.

If individuals fail to comply with The Smoke-Free Illinois Act, they may be subject to a fine between $100 and $250.
